By booking or participating in any activity, rental, lesson, or event provided by Waihi Beach SUP & Kayak (“we”, “us”, or “our”), you agree to the following terms and conditions:
1. Safety First
Your safety is our top priority. All participants must:
• Follow all safety instructions provided by instructors or staff
• Wear mandatory safety equipment (e.g. lifejackets, leashes, helmets where appropriate)
• Listen to safety briefings before entering the water
• Inform staff of any medical conditions or injuries that may affect participation
• Be competent swimmers unless otherwise agreed in writing
• Use equipment responsibly and for its intended purpose only
Failure to comply with safety instructions may result in cancellation of your session without refund.
2. Assumption of Risk
Stand Up Paddleboarding (SUP), kayaking and related activities involve inherent risks including but not limited to:
changing tides, water conditions, weather, wind, physical exertion, marine life, submerged objects, and potential injury.
By participating, you acknowledge and accept all risks and agree that you are responsible for your own safety on the water.
3. Age & Supervision
• Participants under 18 must have written consent from a parent or legal guardian
• Children under 15 must be accompanied or supervised at all times unless part of an approved program
• We reserve the right to refuse participation if safety may be compromised
4. Medical Conditions
If you have any medical conditions, injuries, or concerns that may affect your safety, you must disclose them prior to participation.
We reserve the right to decline participation based on safety risk.
5. Weather, Tides & Cancellations
• All activities are subject to safe weather and tide conditions
• We may postpone, reschedule, modify, or cancel activities at any time for safety reasons
• If a session is cancelled by us due to unsafe conditions, you will be offered a rescheduled booking or credit
• If you cancel within [X hours/days – add your policy], standard cancellation fees may apply
6. Photography & Video
We may capture photography or video during sessions, including water-based photography, for coaching or marketing purposes.
Consent will always be sought prior to use. You may opt out at any time.
7. Personal Responsibility & Conduct
By taking part, you agree to:
• Act respectfully towards staff, other participants, and the environment
• Refrain from alcohol or drug use before and during participation
• Not enter the water if you are under the influence of alcohol or drugs
• Follow all New Zealand water safety and maritime rules
We reserve the right to remove anyone from an activity if unsafe or inappropriate behaviour occurs.
8. Equipment Care
Participants are responsible for any loss or damage to equipment caused by negligence or misuse.
Charges may apply for damaged, lost, or unreturned equipment.
9. Liability
To the fullest extent permitted by New Zealand law, Waihi Beach SUP & Kayak and its staff accept no liability for:
• Injury, loss, damage, or death resulting from participation
• Loss or damage to personal belongings
• Conditions beyond our control
You participate at your own risk.
10. Waiver & Indemnity
By booking or joining any activity, you agree to waive any claims against Waihi Beach SUP & Kayak and indemnify us against all liabilities, claims, damages, or expenses arising from your participation.
11. Privacy
Personal information is handled in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
You may request access to your personal information at any time.
12. Governing Law
These Terms & Conditions are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand jurisdiction.
13. Acceptance
By booking or participating in any Waihi Beach SUP & Kayak activity, you acknowledge that:
